Fraser Statement on Groundwater Ruling

"I applaud the Texas Supreme Court's unanimous ruling that landowners own the groundwater in place as part of their land. This ruling affirms the intent of and also references SB 332 which I authored and passed in 2011.

"The right to own and produce groundwater from beneath your land is one of the most basic of all property rights. By today's ruling the current court affirmed that landowners own the groundwater below their land and the right is constitutionally protected. The decision today went a step further by saying groundwater cannot be taken without adequate compensation.

"For over 100 years, landowners have believed that the law gave them a vested private property right in the groundwater beneath their land and I am pleased that the current court upheld that today."
